Clarifiez les termes du contrat<\/h5>\n\n\n\n<p>Ce n\u2019est pas parce que le client a sign\u00e9 le contrat qu\u2019il a compris ce \u00e0 quoi il s\u2019engage. L\u2019architecte a un devoir de conseil en tout temps, mais ce dernier est modul\u00e9 en fonction du niveau de connaissance et d\u2019exp\u00e9rience de son client. Si le client est novice en mati\u00e8re de construction, ce devoir de conseil est tr\u00e8s \u00e9lev\u00e9.<\/p>\n\n\n\n<p>Rappelez-vous que le client moyen s\u2019attend \u00e0 ce que l\u2019architecte r\u00e9ponde \u00e0 toutes ses demandes pour le prix qui est indiqu\u00e9 au contrat. Prenez donc le temps de passer en revue les modalit\u00e9s du contrat et d\u2019expliquer \u00e0 votre client les \u00e9tapes du projet. Indiquez-lui que le prix forfaitaire n\u2019inclut pas un nombre illimit\u00e9 de r\u00e9visions de plans&nbsp;\u2013 on ne peut pas changer 20&nbsp;fois d\u2019id\u00e9es sur la mani\u00e8re de construire le rez-de-chauss\u00e9e de sa r\u00e9sidence sans en assumer le co\u00fbt\u2009! Mentionnez-lui que des honoraires suppl\u00e9mentaires pourraient \u00eatre factur\u00e9s dans certaines circonstances, et n\u2019attendez pas que le chantier ait pris un an de retard avant de le faire.<\/p>\n\n\n\n<p>Surtout, assurez-vous que le contrat refl\u00e8te les explications que vous aurez donn\u00e9es \u00e0 votre client. Toutes ces explications seront utiles en cas de litige sur la port\u00e9e du contrat. \u0091<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><br>2. Expliquez le r\u00f4le de l\u2019architecte<\/h5>\n\n\n\n<p>L\u2019architecte est le chef d\u2019orchestre du chantier, mais les attentes \u00e0 cet \u00e9gard sont souvent d\u00e9mesur\u00e9es. En effet, le client oublie fr\u00e9quemment qu\u2019il doit lui-m\u00eame prendre des d\u00e9cisions pour mener \u00e0 bien son projet. Il vous revient donc de d\u00e9finir votre r\u00f4le et vos t\u00e2ches dans le projet. Le client doit avant tout comprendre que vous \u00eates l\u00e0 pour l\u2019accompagner dans son processus d\u00e9cisionnel en le conseillant ad\u00e9quatement en fonction des circonstances particuli\u00e8res qui surviennent ainsi que dans son int\u00e9r\u00eat primordial.<\/p>\n\n\n\n<p>Mentionnez \u00e0 votre client que l\u2019entrepreneur est celui qui ma\u00eetrise l\u2019ex\u00e9cution du contrat de construction et qui en choisit les m\u00e9thodes. Indiquez-lui que si l\u2019entrepreneur prend du retard dans les travaux, il appartiendra au client de prendre les moyens et les d\u00e9cisions n\u00e9cessaires, dont peut-\u00eatre celle de r\u00e9silier le contrat avec l\u2019entrepreneur.<\/p>\n\n\n\n<p>R\u00e9it\u00e9rez que vous n\u2019\u00eates pas un conseiller juridique, que vos conseils se limiteront \u00e0 l\u2019aspect technique du chantier et que certaines situations pourraient n\u00e9cessiter le recours \u00e0 un avocat. Expliquez \u00e0 votre client ce que signifie le mandat de surveillance partielle des travaux et ce que cela inclut. N\u2019acceptez pas de faire le suivi financier du projet parce que l\u2019entrepreneur n\u00e9glige de le faire.<\/p>\n\n\n\n<p>Pr\u00e9cisez que si vous n\u2019\u00eates pas mandat\u00e9 pour effectuer la surveillance du chantier, vous ne pourrez pas attester que les travaux sont conformes aux plans et devis dans un certificat de fin de travaux. Pr\u00e9voyez une clause \u00e0 cet \u00e9gard dans votre contrat et demandez \u00e0 votre client d\u2019apposer ses initiales sous cette clause une fois les explications donn\u00e9es.&nbsp;<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><br>3. Planifiez une rencontre avant&nbsp;le d\u00e9but des travaux<\/h5>\n\n\n\n<p>Si votre mandat vise uniquement la r\u00e9alisation de plans et devis pour construction, sans surveillance des travaux, il pourrait \u00eatre fort utile de tenir une rencontre avec votre client et l\u2019entrepreneur avant le d\u00e9but des travaux. Plusieurs litiges naissent de commentaires transmis au client par l\u2019entrepreneur durant le chantier voulant que les plans ne soient pas conformes ou qu\u2019ils ne soient pas clairs. Une rencontre pr\u00e9liminaire permettra de dissiper toute ambigu\u00eft\u00e9.<\/p>\n\n\n\n<p>Lors de cette rencontre, revoyez avec eux l\u2019ensemble des plans et devis. Assurez-vous que l\u2019entrepreneur a pris connaissance de vos plans, r\u00e9pondez \u00e0 ses questions le cas \u00e9ch\u00e9ant et, au besoin, bonifiez vos d\u00e9tails \u00e0 l\u2019issue de la discussion.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><br>4. Documentez votre dossier<\/h5>\n\n\n\n<p>Un dossier bien document\u00e9 est toujours utile en cas de litige portant sur des reproches li\u00e9s au devoir de conseil. Si, en cours de chantier, le client refuse de suivre vos conseils, confirmez par \u00e9crit votre recommandation initiale ainsi que les risques associ\u00e9s \u00e0 sa d\u00e9cision. De cette mani\u00e8re, les reproches \u00e0 votre \u00e9gard seront plus difficiles \u00e0 formuler et votre d\u00e9fense plus facile \u00e0 faire valoir.<\/p>\n\n\n\n<p>Finalement, contactez le Fonds en cas de doute.
