{"id":560,"date":"2016-12-11T20:20:00","date_gmt":"2016-12-12T01:20:00","guid":{"rendered":"https:\/\/www.oaq.com\/ressources\/publications-de-loaq\/linspection-preachat\/"},"modified":"2026-02-25T15:39:26","modified_gmt":"2026-02-25T20:39:26","slug":"linspection-preachat","status":"publish","type":"post","link":"https:\/\/www.oaq.com\/ressources\/publications-ordre\/linspection-preachat\/","title":{"rendered":"L&rsquo;inspection pr\u00e9achat"},"content":{"rendered":"\n<p>Bien que l\u2019inspection pr\u00e9achat ne soit pas une activit\u00e9 r\u00e9serv\u00e9e aux architectes, plusieurs membres de l\u2019OAQ agissent \u00e0 titre d\u2019inspecteur. Or, ce domaine pr\u00e9sente des enjeux majeurs, notamment en raison du nombre et de l\u2019importance des litiges li\u00e9s \u00e0 l\u2019existence de vices cach\u00e9s. Au fil des dossiers qu\u2019il a trait\u00e9s, le Fonds des architectes a pu tirer les enseignements suivants&nbsp;:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">1. Ne pas n\u00e9gliger le contrat d\u2019inspection pr\u00e9achat<\/h4>\n\n\n\n<p>Dans ce domaine comme dans tous les autres, le contrat \u00e9crit est recommand\u00e9. Celui-ci est d\u2019une importance capitale puisque la responsabilit\u00e9 de l\u2019inspecteur sera \u00e9valu\u00e9e en fonction des obligations qui y sont d\u00e9finies. Les contrats de cette nature sont des contrats de service. Cela implique que l\u2019inspecteur a le libre choix des m\u00e9thodes d\u2019ex\u00e9cution \u00e0 mettre en place afin de remplir ses obligations contractuelles. Comme il n\u2019existe pas de contrat standardis\u00e9 et que l\u2019\u00e9tendue des obligations est susceptible de varier d\u2019une inspection \u00e0 l\u2019autre, il est important d\u2019int\u00e9grer au contrat les r\u00e9serves n\u00e9cessaires quant \u00e0 la responsabilit\u00e9, en tenant compte des dispositions pr\u00e9vues au Code de d\u00e9ontologie des architectes.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">2. Pr\u00e9ciser les limites d\u2019une inspection pr\u00e9achat<\/h4>\n\n\n\n<p>Une inspection pr\u00e9achat ne constitue pas, pour l\u2019acheteur, une garantie contre les vices cach\u00e9s. Il faut donc d\u00e9finir pr\u00e9cis\u00e9ment les limites d\u2019une telle inspection. \u00c0 cet \u00e9gard, la clause suivante peut \u00eatre int\u00e9gr\u00e9e au contrat&nbsp;:<\/p>\n\n\n\n<p>\u00ab\u2009L\u2019inspection pr\u00e9achat est une inspection visuelle approfondie. Elle ne comporte aucune mesure ni aucun test destructif permettant de proc\u00e9der \u00e0 l\u2019analyse des \u00e9l\u00e9ments cach\u00e9s ou inaccessibles. Le rapport obtenu n\u2019est pas une garantie de l\u2019absence de vices cach\u00e9s ni une assurance de quelque nature que ce soit. L\u2019inspection pr\u00e9achat n\u2019est pas une analyse de conformit\u00e9 de l\u2019immeuble aux divers codes et normes applicables.\u2009\u00bb<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">3. Attention aux normes de pratique d\u00e9clar\u00e9es<\/h4>\n\n\n\n<p>Le contrat fait normalement \u00e9tat des normes de pratique qui seront suivies par l\u2019inspecteur lors de la r\u00e9alisation de son mandat. Ces normes de pratique peuvent \u00eatre jointes en annexe au contrat ou simplement y \u00eatre mentionn\u00e9es. Si l\u2019inspecteur d\u00e9clare se soumettre \u00e0 une norme de pratique \u00e9tablie par l\u2019industrie, par exemple, cette derni\u00e8re devient pertinente dans l\u2019analyse de sa responsabilit\u00e9 professionnelle. Il faut aussi se rappeler que le fait d\u2019avoir suivi une norme de pratique n\u2019est pas un moyen de d\u00e9fense entra\u00eenant automatiquement l\u2019absence de responsabilit\u00e9.<\/p>\n\n\n\n<p>Le Code de d\u00e9ontologie des architectes peut \u00e9galement \u00eatre utilis\u00e9 par les tribunaux dans l\u2019analyse de ce que constitue le comportement d\u2019un inspecteur prudent et diligent plac\u00e9 dans les m\u00eames circonstances, lorsque ce dernier est membre de l\u2019OAQ.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">4. Attirer l\u2019attention de l\u2019acheteur sur l\u2019importance des tests suppl\u00e9mentaires<\/h4>\n\n\n\n<p>Il arrive que l\u2019inspecteur pr\u00e9achat recommande \u00e0 l\u2019acheteur de proc\u00e9der \u00e0 des tests suppl\u00e9mentaires s\u2019il n\u2019est pas en mesure de se prononcer avec certitude sur la pr\u00e9sence d\u2019un vice ou sur les cons\u00e9quences potentielles de ce dernier. Or, dans certains rapports d\u2019inspection, cette recommandation est noy\u00e9e dans plusieurs dizaines de pages, ce qui emp\u00eache l\u2019acheteur d\u2019en saisir l\u2019importance. Pour \u00eatre certain que l\u2019acheteur ne passe pas \u00e0 c\u00f4t\u00e9, le rapport doit mettre l\u2019accent sur la n\u00e9cessit\u00e9 d\u2019effectuer les tests en question, et clairement pr\u00e9ciser que ceux-ci doivent \u00eatre faits AVANT l\u2019acquisition du b\u00e2timent. Ainsi, si l\u2019acheteur omet de suivre cette recommandation, il ne pourra pas par la suite invoquer le fait que le rapport n\u2019\u00e9tait pas suffisamment clair quant \u00e0 l\u2019importance des tests.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">5. Attention aux recommandations de travaux correctifs<\/h4>\n\n\n\n<p>Un inspecteur qui sugg\u00e8re des correctifs \u00e0 apporter \u00e0 l\u2019immeuble engage sa responsabilit\u00e9 quant \u00e0 ces recommandations. Il peut donc \u00eatre poursuivi si ces travaux, une fois effectu\u00e9s, se r\u00e9v\u00e8lent inefficaces et qu\u2019ils causent des dommages \u00e0 l\u2019acheteur.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">6. Indiquer m\u00eame les probl\u00e8mes mineurs<\/h4>\n\n\n\n<p>Il est essentiel que le rapport \u00e9nonce tous les probl\u00e8mes constat\u00e9s, m\u00eame ceux qui peuvent \u00eatre consid\u00e9r\u00e9s comme mineurs. En effet, ces \u00e9l\u00e9ments, qui ont souvent peu d\u2019importance pris isol\u00e9ment, peuvent globalement entra\u00eener des cons\u00e9quences financi\u00e8res majeures pour l\u2019acheteur.
