L\u2019architecte devrait savoir comment communiquer au propri\u00e9taire ses r\u00e9serves et mises en garde afin de limiter le risque de r\u00e9clamation \u00e0 son endroit. On peut d\u2019embl\u00e9e discerner deux enjeux potentiels\u2009: premi\u00e8rement, un accident pourrait survenir sur le chantier pendant les travaux; deuxi\u00e8mement, des frais additionnels pourraient \u00eatre imput\u00e9s au propri\u00e9taire du fait de l\u2019occupation pr\u00e9matur\u00e9e du b\u00e2timent. Nous nous concentrerons ici sur la question de la s\u00e9curit\u00e9 au chantier.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Une d\u00e9nonciation explicite<\/h4>\n\n\n\n<p>L\u2019obligation de l\u2019architecte est de pr\u00e9senter les risques par \u00e9crit, de mani\u00e8re claire et objective. Il revient ensuite au propri\u00e9taire de prendre une d\u00e9cision en cons\u00e9quence. Au bout du compte, c\u2019est lui qui demeure responsable de la s\u00e9curit\u00e9 des usagers de son b\u00e2timent.<\/p>\n\n\n\n<p>Dans cette optique, l\u2019architecte peut utiliser le texte qui suit dans sa&nbsp;lettre de d\u00e9nonciation (mise en garde) au propri\u00e9taire.<\/p>\n\n\n\n<div class=\"wp-block-group has-powder-blue-background-color has-background is-layout-flow wp-block-group-is-layout-flow\">\n<p><em>\u00ab Vous nous avez indiqu\u00e9 que vous entendiez occuper le b\u00e2timent \u00e0 compter du [indiquer date]. Or, certains travaux pouvant pr\u00e9senter une incidence sur la s\u00e9curit\u00e9 des usagers du b\u00e2timent n\u2019ont pas \u00e9t\u00e9 achev\u00e9s en date des pr\u00e9sentes.<\/em><br><em>Ainsi : [\u00c9num\u00e9rer les travaux \u00e0 achever] Il vous appartient de d\u00e9terminer si l\u2019occupation pr\u00e9matur\u00e9e du b\u00e2timent dans ce contexte soul\u00e8ve des enjeux de s\u00e9curit\u00e9 particuliers et, le cas \u00e9ch\u00e9ant, d\u2019effectuer les choix n\u00e9cessaires. \u00bb<\/em><\/p>\n<\/div>\n\n\n\n<p>La lettre en question doit \u00eatre adapt\u00e9e aux circonstances. L\u2019architecte peut par exemple y pr\u00e9ciser que certains travaux inachev\u00e9s repr\u00e9sentent un danger pour les usagers; pensons \u00e0 un garde-corps non install\u00e9 ou encore \u00e0 un syst\u00e8me de protection incendie non fonctionnel. Dans ce contexte, la d\u00e9nonciation au client doit \u00eatre hautement explicite. La formulation suivante peut alors \u00eatre utilis\u00e9e\u2009:<\/p>\n\n\n\n<div class=\"wp-block-group has-powder-blue-background-color has-background is-layout-flow wp-block-group-is-layout-flow\">\n<p><em>\u00ab Veuillez noter que l\u2019absence de rampe pr\u00e9sente une incidence directe et imm\u00e9diate sur la s\u00e9curit\u00e9 des occupants. Il pourrait en r\u00e9sulter des risques significatifs auxquels nous ne souhaitons pas \u00eatre associ\u00e9s. Votre soci\u00e9t\u00e9 et l\u2019entrepreneur g\u00e9n\u00e9ral sont seuls responsables des dommages susceptibles d\u2019en r\u00e9sulter. \u00bb<\/em><\/p>\n<\/div>\n\n\n\n<h4 class=\"wp-block-heading\">Des conditions pr\u00e9cises<\/h4>\n\n\n\n<p>En outre, la prise de possession avant la fin des travaux devrait \u00eatre document\u00e9e par l\u2019architecte \u00e0 l\u2019aide d\u2019un formulaire qui fait notamment \u00e9tat des \u00e9l\u00e9ments suivants\u2009:<\/p>\n\n\n\n<div class=\"wp-block-group has-powder-blue-background-color has-background is-layout-flow wp-block-group-is-layout-flow\">\n<ul class=\"wp-block-list is-style-classic\">\n<li>Que la prise de possession n\u2019affecte en rien les droits du ma\u00eetre de l\u2019ouvrage relativement \u00e0 la qualit\u00e9 des travaux et au degr\u00e9 d\u2019ach\u00e8vement de l\u2019ouvrage et ne modifie en rien les droits et obligations des parties, sauf pour ce qui est express\u00e9ment indiqu\u00e9 dans l\u2019attestation\u00a0de prise de possession;<\/li>\n\n\n\n<li>Que le ma\u00eetre de l\u2019ouvrage s\u2019engage \u00e0 donner acc\u00e8s \u00e0 l\u2019entrepreneur \u00e0 toute partie de l\u2019ouvrage, aux moments convenus, afin qu\u2019il puisse terminer les travaux conform\u00e9ment \u00e0 l\u2019\u00e9ch\u00e9ancier contractuel;<\/li>\n\n\n\n<li>Que l\u2019entrepreneur s\u2019engage \u00e0 permettre l\u2019acc\u00e8s au ma\u00eetre de l\u2019ouvrage en tout temps et dans des conditions s\u00e9curitaires et \u00e0 finaliser les travaux (fournir les services requis) conform\u00e9ment \u00e0 ce qui est pr\u00e9vu dans l\u2019attestation de prise de possession;<\/li>\n\n\n\n<li>Que, le cas \u00e9ch\u00e9ant, des parties de l\u2019ouvrage sont exclues de l\u2019attestation (si des travaux sont termin\u00e9s);<\/li>\n\n\n\n<li>Les constats de l\u2019architecte, notamment quant aux travaux pouvant pr\u00e9senter une incidence sur la s\u00e9curit\u00e9 des usagers.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<p>En proc\u00e9dant de cette mani\u00e8re, l\u2019architecte limite les risques qu\u2019une r\u00e9clamation lui soit pr\u00e9sent\u00e9e par suite de la demande de son client d\u2019occuper les lieux. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Il arrive que, pour des motifs divers, le propri\u00e9taire d\u2019un b\u00e2timent en chantier souhaite en prendre possession avant que les travaux soient achev\u00e9s.
